That's a DMCA "takeown notice". According to the Digital Millenium Copyright Act (DMCA) a copyright holder can order a service provider to delete a copy of his work immediately, with no paperwork, no court order, no establishing documentation. All he has to do is email the provider and tell them to do it. If they're not really the copyright owner you can complain and have them fined, but it's rare for that to happen. The law is often abused; a lot of people (myself included) think it's a terrible idea. It's actually nice of LJ to let you know about it first... it would be perfectly legal for them to delete it without even telling you.

Anyhow, the point is, just because you give the artist credit doesn't mean you have the right to use the picture. The artist decides that, as well as how much he'll charge for it (if anything), and he's completely within his rights to tell you to stop. In general, if you post a copyrighted picture (and all pictures are copyrighted until many years after the author's death) without the explicit permission of the author you're breaking the law. Yes, that means that almost all the pics you see on LJ and elsewhere are illegal. There are exceptions... if you see a logo for a Creative Commons (CC) license, for example, the author may have given specific permission to reporduce the work. There's also the concept of "fair use" which states that you can reproduce a work (usually just excerpts and small portions) for educational and critical purposes.

The good news is that you're not in trouble. If you comply with a takedown notice you have nothing more to worry about.

After last nights little fiasco with Live Journal; see the entries and responses on [livejournal.com profile] smutday, I have found that there is a new site InsaneJournal. Some LJ members are already there as a back up. Apparently the owner is very open to posts of all kinds and refuses to bow down to any outside pressure. I just joined in case, and will be backing up some of my posts. There may of been a perfect and valid reason for what happened. But why one photo, and not others? Still think there is something fishy. The pic was posted on [livejournal.com profile] blossom_of_bone, a site where one posts photo, art, drawings of homoerotic art, many of it vintage. I still think odd only one pic gets nixed and not others.

I must say that my family and I have moved quite a bit. A good thing, for I have always found that "every city" has it's good and bad points. So when someone says, oh! That city. Yuk! I say, that there must be some good points and areas in every town (well almost).
In all, I have lived in 12 homes; 8 cities.

Sherbrooke Quebec; My parents in the 50's I would say were "Home Flippers" Bought and sold. I lived in 4 homes

Menlo Park Califiornia: In the 60's 70's this was sort of a middle class to upper middle class town. Big points is that it was next door to Stanford Univeristy, and Palo Alto. The birth of Silicon Valley began in this town and Stanford U. Later with the Silicon Valley boom, this town and the real estate prices just boomed. My parents sold before that time. Too bad. Irvine and Newport Beach: I went to college at UC Irvine. Rented a room in Irvine for a year. Then my frat bro's and I rented a 4 bedroom house on Balboa Island ($525/month!). The beach life. OY! My GPA suffered. I lived in 2 homes.

put up a Christmas tree, 3rd year in a row. Reason. My stuff is so tightly squeezed in storage, it will be a pain to take out and put back. I will just put lights up on my balcony, maybe.

HOA: I just got a letter from my Home Owners Association that we have a $500 assessment. When did that happen? The info must be under my piles of papers. Happy Holidays!

PASSPORT: After weeks of waiting I got a DHL package, with my paperwork and photos. Apparently the small smirk on my face is not correct. Photos can not have smiling of any kind. So. Now I need to get the photos redone, drive 30miles to my family dentist to verify the photo, then send back to Canada. Happy Holidays!

VACANCIES: After struggling to fill up my apt building, of course the owners insistance of 12% rent increases, have now given us 5 vacancies. And we have 4 more coming up at the end of the month. And they are blaming me? And how come no traffic during Thanksgiving? Hello? It was a holiday. Now I am pressured to fill it up through the month. Happy Holidays!

COMCAST: As a property manager, I can get a discount on my service. I have been working on this for over 3 months, with no results. The accounting division is slow as snails. Or should I say as slow as the Slowskies. I really detest the idea that we only have one choice of cable company. No control. No competition. Happy Holidays!

LIVEJOURNAL: I am being overly dramatic. But last nights flagging incident irked me. One photo singled out due to copyright. Yet the page had 3 more by the same artist, and not singled out? Happy Holidays!

GYM: Fees are due. Happy Holidays!

TAXES: I owe over $1300 in property taxes by December 10th. Happy Holidays!

GIFTS: I have seven people to buy for. Even if it's one each. Happy Holidays!

CHRISTMAS: If I can't find someone to cover for me, I will have to work the 24th and the 26th. That means I will be driving to Sacramento on the 24th. Usually this takes 1.5 hr. That night possibly 5 hrs. Happy Holidays!

Well, I usually am in a good mood as the holiday approaches. And the distraction always relieves my worries. It just gets so pressured. No tree? I will miss seeing my ornament collection. Instead of worrying about that, maybe I should think about the whole reason for Christmas in itself. Giving. Give the best one can.
